We want to discuss your rights.  Many people are not aware that police may not detain a civilian without probable cause.  And even if probable cause is present, police may not detain someone more than 24 hours before seeing a judge.  We see numerous clients who are detained far more than 24 hours before seeing a judge.  This delay alone can give rise to a civil rights violation, however, every case is different so call or email as soon as possible after the arrest to advise us of the situation.


If you are injured by police, prompt medical care will protect your health and your future legal matter.  Even if police refuse to allow you to seek medical attention while in custody, request medical attention as soon as you are released from custody.  If you are not released from custody, seek medical attention at Riker's Island.  If you are injured, keep seeking medical attention until you receive it.  This will protect you in several ways when your turn in court comes up.


People who have been victimized by NYPD have many options, including calling CCRB and Internal Affairs.  However, not every case is appropriate for CCRB and Internal Affairs and therefore its important to speak to a lawyer before choosing a course of action. At times, CCRB is a valuable resource.  Other times, it will not assist and could be detrimental to your case. CCRB is careful to record every statement given to them by a victim of police misconduct and these statements will be used in court against the victim if they spoke emotionally or without thinking the matter through carefully. Therefore, its important to seek legal advice as soon as possible.

VERDICTS AND SETTLEMENTS

Please note that previous settlements and verdicts are not a guarantee of future results. The follwing list is not comprehensive, and is intended only to provide a sample of our work.

  • 2019: $275k settlement for a car accident. Passenger in a car hit by a small truck in Manhattan. Bronx venue.
  • 2019: 40k.Pedestrian hit by a police car falsely claiming to have had on lights and sirens
  • 2019: $87,500. Woman hit in a car at an intersection. She missed work for 6 months.
  • 2019: $50k.Passenger in a car hit by a police vehicle.
  • 2019: 4 people falsely arrested in Brooklyn. City paid clients and lawyer in excess of $100k.
  • 2019: $48k. Client settled his car accident case with insurance company before suit.
  • 2018: City raided apartment, injured a few people, arrested several and paid over 100k in damages. City had a warrant.
  • 2018: 2 Clients arrested by police and one client secretly recorded incident. City paid $250k.
  • 2018: 2 Clients had an argument with police which resulted in a scuffle. City paid more than $75k

  • Verdict: Summer of 2013. Man arrested following an argument with a store manager. Police punched man at the police station who fell suffering nasal fractures and dental injuries. Man was charged with menacing, assault and battery and harassment. All charges were dismissed. Jury awarded man $260,000 for false arrest and $75,000 in punitive damages.
  • Settlement: 2013. Woman tripped over broken sidewalk suffering a trimalleolar fracture. The plaintiff named the landowner of the commercial premises, the tenant and the City. The case settled prior to trial for $310,000, including $260,000 from the landlord and $50,000 from the tenant.
  • Settlement: 2013. Man assaulted by police and sustained a fractured leg. Police accused him of assaulting them. Case settled for $70,000 after plaintiff's deposition.
  • Settlement: 2013. Woman arrested without cause by NYPD and held against her will. Case settled for $12,000.
  • Settlement: 2013. Man loses four teeth when tripping on wrapping tape left outside store. Case settled for $95,000.
  • Settlement: 2013. Man arrested at a Brooklyn Precinct. Officer claimed man threw chairs at the precinct but another worker at the police station denied this. Officer bullied man, arrested him with force but no injuries requiring hospitalization. Case settled for $55,000 in Federal Court.
  • Settlement: 2013. Three young men were in an apartment in Brooklyn when police were raiding an apartment next door. One of the young men went out of the apartment to dispose of garbage. Police arrested him and then searched the apartment the men were in and arrested all of them. All charges were dismissed. The three men received a total of $65,000 for the illegal search and arrests.
  • Settlement: 2013. Police allegedly mace and break leg during arrest of man assisting cousin wanted for questioning – cousin claims emotional trauma and loss of reputation. The case settled prior to trial for $70,000 for the man and $12,000 plus attorney fees and costs for the cousin.
  • Settlement: 2013. Man was stopped in Brooklyn outside of a housing project. Police assaulted man and brought him to the precinct without a valid reason. Police accused him of having a crack pipe. All charges were dismissed. Client was lightly injured. Case settled for $35,000.
  • Verdict: Summer of 2012. Man arrested in Bronx following an argument with his girlfriend. Police claimed man was yelling and screaming, but neighbors denied this. Police broke man's finger while arresting him, brought him to a hospital and left him there. He was not charged. Federal jury awarded man $125,000 for false arrest and $500,000 in punitive damages. Case is currently on appeal and case may have to be retried.
  • Settlement: 2012. Man goes to precinct to report identity theft. He is assaulted by an officer and charged with disorderly offense after making suggestion noting officer's badge number. Case settled for $55,000.
  • Settlement: 2012. Police arrest man for crack cocaine sale despite the absence of probable cause. He is incarcerated for six days at Riker's Island before the criminal charges were dropped. Case settled for $27,500.
  • Settlement: 2012. False arrest/malicious prosecution. Plaintiff agrees to watch friend's young children during emergency. Plaintiff brings children home when officers forcefully order him away from house and place him under arrest for disorderly persons offense. Criminal charges subsequently dismissed. Case settled for $25,000.
  • Settlement: 2012. Plaintiff contends security guards at City Department of Homeless Services assault him after he begins videotaping arrest of his friend following dispute. Multiple contusions. Soft tissue injuries. Criminal charges were dismissed. Case settled for $25,000.
  • Settlement: 2011. Police arrest all five individuals who are living in home after search pursuant to warrant results in finding of unauthorized prescription drugs in one bedroom of home. All criminal cases subsequently dismissed. Case settled for $57,000.
  • Settlement: 2011. Defendant runs stop sign injuring two passengers in another vehicle. Case settled for with the passenger suffering the knee injuries receiving $90,000 and the coplaintiff receiving $20,000.
  • Verdict: 2010. Procedural due process. Failure of city to provide hearing in conjunction with suspension of gun store licenses following 9-11 attacks. Inability to sell guns for approximately one month. Alleged emotional distress of gun store owner. Jury awarded $10,000 for economic loss and nominal damages for emotional distress.
